Delhi: There is no stay against the Kerala High Court's order not to use title-deed Land for other purposes. The Supreme Court clarified that there is no need to stay the High Court judgment as the final argument will be heard immediately. The petitioners stated that the mining was done after obtaining all the permissions from the appropriate authorities concerned.
It has been stated that the court will consider the case again after a fortnight, stating that all aspects related to the use of title-deed land for other purposes should be considered in the state. Quarry owners Pobs Granites and Rafi John approached the Supreme Court against the Kerala High Court order.
Senior advocate KV Viswanathan, advocates EMS Anam, MKS Menon, and Usha Nandini appeared for the quarry owners. Advocate James P. Thomas appeared as Srinivasan, a native of Thrissur, who had filed a petition in the case. For the state, CK Shashi and Abjullah Naseeh appeared as standing counsel.
Meanwhile, the Supreme Court today also heard the ED's plea to shift the trial proceedings in the gold smuggling case out of Kerala. The Supreme Court has added Kerala as a party in the petition. Kerala's demand has been accepted. Kapil Sibal said that the State's affidavit in this regard will be filed on Friday. The Supreme Court has said that it will decide on the plea to shift the trial to Bengaluru in the next hearing. The plea will be heard again next Thursday. The bench chaired by Chief Justice U. Yulalith accepted Kerala's application to join the case.
